Defense: Norwood 'Lost It'

Defense says they will argue Brittany Norwood killed Jayna Murray during a fight without premeditation.

 

Brittany Norwood killed Jayna Murray at Bethesda's Lululemon store March 11 during a "horrific fight," Norwood's defense team said during opening statements Wednesday.

But the crime happened without premeditation, defense lawyer Douglas Wood argued. "Something erupted between these two young women in the store that night."

"Brittany Norwood lost it, ladies and gentlemen," Wood told the jury. "There's no doubt about it." 

Norwood, 29, stands accused of killing Murray, 30, at the downtown Bethesda store where the two women worked in March.

Wood said Norwood "grabbed the stuff within her reach and unfortunately and stupidly caused the death of Jayna Murray." 

The crime, he said, took about 10-15 minutes.

The jury, Wood said, were chosen because of their willingness to judge evidence impartially, and he urged them to keep an open mind.

Prosecutors painted a much different story during opening statements, given just prior to the defense team's. Montgomery County State's Attorney John McCarthy said Murray sustained at least 322 wounds, the majority of which occurred while she was alive. A hundred and seven of those wounds were defensive, which he said the medical examiner would testify were the most she had ever seen.

McCarthy said Norwood used weapons from within the store including a hammer, a wrench, a knife, a rope, a box cutter, and a merchandise peg. The peg was among the items he said left a pattern of injuries in Murray's skull, indicating she had been beaten with the same item multiple times.

McCarthy showed the rope and the peg to the jury, along with photographs of Murray's body, Norwood when she was discovered inside the store's restroom, and a photograph of Murray's skull.

Next door at the Apple Store, a few employees heard noises shortly after 10:05 p.m. — when the two women re-entered the store — loud enough to cause them to bang on the wall. One employee heard someone say, "Oh God, please help me."

Norwood is guilty of premeditation in this, the amount of time and various instruments she used beating her victim and trying to cover it up after calling her back to the store, how could it be anything else? Miss Murray had over 100 defensive wounds on her body trying to save herself, Norwood had plenty of time after the first blow to stop, but continued on for like 15 minutes. 15 minutes is a tremendous amount of time to be trying to kill someone, Miss Murray died a horrible death in terror!

There are only a handful of "animals" within every race that creates issues for the remaining, law-abiding, hard working masses. Most women in the black community are not animals but are hard working, level-headed and deserve a fair shake in this society. this is sick, the store obviously knew something was going on between these employees and ignored it. This woman didn't lose it, it was premeditated and well thought out, she thought she would get the self defense clause, there is no equal justice here but to sentence her for life. If the other person had equal objects to fight back with and Norwood sustained almost equal injury or if there was evidence that Norwood needed to fight for her life then it is self defense, but the other woman sustained unjustified injury. Norwood should be locked up for life in prison, she could have walked away, the other lady could not run obvioulsy from the first blow. And how the hell were all these weapons in reach? Who conducted Norwood's background check?

You may be right George but the fact is, even with a better understanding of ourselves as you put it, we are all not at fault. I am so sick of this blaming society as a whole for what one person did. I don't know about anyone else but I remember reading or hearing a story after the murder that Brittany Norwood worked at another Lululemon store in the Tysons Corner area but was transferred to the Bethesda location before she was suspected of stealing but she was also a great salesperson so the company didn't want to lose her. The parents should sue Lululemon although they probably won't especially since they attended the grand re-opening of the Bethesda store. As for Ms. Norword, she should spend the rest of he natural life in jail because I don't think the death penalty applies to this case. It was rage killing but I don't believe it was premeditated.

Not too sure about that story, I've never found a company anywhere that won't fire a person on the spot for stealing, regardless of how good of a salesperson they are. Not to say that people don't exist that make stupid business decisions, but it doesn't seem terribly bright to actually transfer someone that you could put in jail. What's the point in a transfer, to let her be someone else's problem? "Oh, we're transfering a sales clerk to your store--keep an eye on her though, she's been stealing from us regularly." And... sue the store? For what? Their daughter's life?

Praying will do nothing. It's clear the perpetrator needed counseling and maybe medication. Do you think any religious icon can affect and remedy an individual's brain chemistry and rage? And I can tell you from experience -- it doesn't help or shorten the grieving process. If people want to be good to the affected families, they should volunteer to bring meals, offer to drive, assist with household chores and pitch-in to babysit. In other words, help with life's daily obligations as they cope with this aftermath. Offering prayers is a cop-out to offering genuinely needed help. "Actions speak louder than words."

IMHO...we have an entire generation, and then some, that have been raised on a crappy diet. Sugar and fat. If you research into what a junk/fast food diet does to one's body, I feel, it explains to some extent, why "everyone" is depressed, angry, (to the point of hurting/killing someone!) inpatient, intolerant and so on. Hormones and blood sugar out of whack can create a monster. Add to the mix the stress of today's economy, living in unsafe communities, being uneducated, (by choice or otherwise) and poor choices used to escape one's situation, albeit temporarily, such as alcohol and or drugs. I am not excusing this behavior by any means. I am speaking from personal experience from being diagnosed incorrectly, years of anti-depressants which exacerbated the underlying problem, along with years that I put my family through so much stress from my outbursts and anger. What changed? A wonderful endocrinologist! After extensive tests ( 2 hours total for me) she discovered by changing my diet, getting my Vitamin D up to a normal range, 6-7 small HEALTHY meals throughout the day and increasing my exercise got my body firing on all cylinders and in the PROPER firing order. FEELING more energetic, stronger and alert allowed me to attain a more positive outlook with greater ease. Twenty five years of a slowly increasing hell and now as I am closer to 60 than 30, I feel 25! Just food for thought. Nothing is a fix all, but you are what you eat. Garbage in...garbage out.

@karla - Yes, people have been that angry, but they won't admit it. Like you I don't condone murder. Everybody is calling the woman demented and deranged, but nobody knows how far they will go until they are in that position. If anybody is pushed too far, or feels theatened that person will act and cause harm to another individual. I'm not saying that the woman should not pay for what she did, because she admitted she killed Ms. Murray. I don't think it has anything to do with color. As @Lisa stated you don't know what other people are going through. For example a man on my job was constantly harrassed, written up for little things, and targeted by our supervisor in attempt to get rid of him. Why? Because she felt he was fat and gross to look at (those are her words). He was given a notice to meet with the director, supervisor and HR. He snapped - he came to work and shot and killed the supervisor, the HR specialist, a administrative assistant and he shot the director twice in the face and he probably would have killed her if the security guards hadn't jumped him from behind. My point is that we don't know what will make a person snap. WE all are capable of committing murder if we are pushed to the limit.

The parents of the victim should bring a cause of action against Lululemon. As the employer had prior knowledge of this employee's erratic behavior, management should have taken step to mitigate this employee's exposure to other staff. There is no question that Lululemon has culpability in this case. There are a lot of excellent personal injury attorneys in Maryland.

My concern is the Apple store employee. This idiot has to know that if someone is desperate enough to call on God, which everyone is afraid to do these days for fear of getting sued, had to be a desperate situation. For God's sake, the Apple store is notorious for telephones. Did he or she not realize that if something had gone awry at that store next door and they were close enough to hear screams and cries, the people or person could have come over to the apple store and given them a run for their money? And I wish I could be the customer walking by to hear that Apple store employee Cry out, God, please help me! it would be extremely hard for me to ignore that. "GOD, PLEASE HELP US ALL!"

According to the report the victim received 322 injuries/hits in 15 minutes. As a hand-to-hand combat instructor, something does not add up. This equals 3 blows per second for 15 minutes!!! I do not know of any trained individual (far less an untrained one) capable of maintaining such an onslaught. Either this was the work of several persons or certain basic facts are incorect.

Try as they might, there is simply no acceptable defense which can be dreamed up by the lawyers. Forget all this PC nonsense about delving for some imaginary psychological flaw or subliminal motivation; this is the sort of crime which justifies punishments like public stoning. Hopefully, at least 322 stones would find their target. From my perspective, there is no "cruel and unusual punishment" harsh enough for this subhuman and an example needs to be set. Life in prison still translates to Alive, and that is an unacceptable outcome.

You read an article about a murder, and you know it all. Most states have very specific requirements for the death penalty, one of those is usually premeditation or laying in wait. Crimes of this level of violence are seldom premeditated except by complete lunatics (like Manson), this kind of violence is almost always the result of someone just flipping out. Equally as funny is the people screaming for her head will ALWAYS be the same ones who call mid-easterners animals for beheading criminals. I notice a lot of women doing it here. What could a CO-WORKER possibly do or say to merit an attack? What type of unstable animal gets hired to work with others? Whoever hired his animal put every customer who entered the store at risk! Furthermore, why were tools of that nature so close at hand in a retail store? It was not a hardware store. Defense can argue it was not premeditated, but common sense says no one uses that many "weapons" and engages in such a deadly attack for that length of time without having thought about it ahead of time. If she had "snapped," one weapon would seem reasonable and a spontaneous attack would not involve 322 wounds, 107 of them defensive. She is not fit for society, no evidence she can be rehabilitated so why should the taxpayers pay for her housing, clothing and food for the rest of her worthless life? She deserves death and not by lethal injection. Strap her in the chair and throw the switch!

When people are killed for various reasons that "we" don't like, we call it "murder". Then "we" call it "the death penalty" when "we" murder them. We all have our own opinions, This crime by Norwood was not premeditated, Norwood just lost it, however, she is a sick person and will spend the rest of her life in prison, to have done this crime and then try to cover it up, no person deserves this, however, folks need to mind there own business, Norwood was suspected of stealing, it should have been her supervisors that tended to this issue and if Murray would have mind her own business then maybe should would be alive today, some folks have a tendency of getting themselves involved and you never know what state of mind a person is in. fact of the matter, this woman took a life. Why should we as tax payers foot the bill for her to be incarcerated for the rest of her life. She gets free room and board for taking someone's daughter, sister, lover, wife and such away. Even the bible says " an eye for an eye " . She took a life so why does she deserve to live and why should other's have to pay for her to live ?

This killing has deeper roots. They were obviously, both arguing about something. The "something" needs to be found out, My guess, It was either a very large sum of money, or deeper relationship...than known. By all the different items used and as many hits the victim's body took, there was something huge going on, and this female was not going to let that "something" go.

@having fun... was the word "excuse" or "excused" ever used? No, it was not. The only "nut job" here is you. Everyone here is just Stating their opinions, in this Tragic Case... A life was taken, but no one can give "justice" because the pain will never go away from the lost life. Bottom line, there is more to the story... Obviously, the person who beat and killed this woman, thought it was the greatest of ideas to lay hands on the victim and take her life. Excusing herself to the use of Self Defense. LOL!

@Heidi - The article states 'when they reentered the store' and we all know this happened late in the evening. As a Retail Manager, I can tell you almost all companies do bag checks at the end of shifts. If Norwood had a history of theft, maybe Jayna found something that set the unfortunate chain of events in motion. It's all speculation until Norwood decides to be honest about what really happened. I know I have personally been put in some scary situations with employees myself...

This is a horrific crime, no doubt about it, but I would add that this kind of rage had probably been building up in her for some time.. Maybe she had an abusive husband. I have met lots of people that take their rage out on someone other than the individual that caused the rage. They usually pick a weaker person that is easy to beat up on.. Very disturbing, but a reality. She does need to be locked up and hopefully will someday understand what she did and how truly disgusting it was. An act of a complete dumb animal with no control over their own self.

I am so sick of people trying to make excuses of why a person kills. She must of done this because of how she was raised or because she was black and the other was white. Come on. She killed a woman. She needs to be punished. Unless you have been involved in a murder you have no idea what is going on in the families that are left behind to have to remember daily what happened to their loved ones. I do I had my grandparents murdered. We know who did it but can't put him away. You are reminded daily of it because of things like this. Trying to make an excuse for her is pure BULL. As far as the store next to them that heard cries of help face it we live in a society that people are afraid to get involved in anything anymore and that my friends is very disturbing. According to Bible prophecy we are in the last days before the Great Tribulation and the Battle of Armageddon. The bible speaks of these types of senseless murders, But it also speaks about not to judge but to pray for people like this who obviously don't know who God is in their life. So I say yes she needs help but so did many murders in the bible that God used for good. On the cross next to Jesus was murderer and and a theft and he said to them as surely as you are here with me today you will be in heaven with me tomorrow. (Already forgiven). LuLu Lemon should be responsible!! My daughter worked there and she was left alone at night to close up the store and go through the back parking lot to her car..very dangerous, especially if someone knows the ropes of how the inner workings of the store is. LuLu Lemon is verpriced and they treat thier empoyees like crap..make them compete against each other all the while chanting thier Namaste approach. So Sad!

I do remember when this story came out reading about something where Murray somehow/someway came accross something Norwood was doing which could cause her to lose her job (I think it was in fact stealing). She contacted Managers regarding this and I believe they were supposed to have a meeting the following morning. I may be wrong, but this is what came to mind as I'm reading this followup on the case. So, yes this does show a motive. What is really pathetic here is all the people trying to think of some rhyme/reason for this- a racial issue, some sort of argument b/t the two, some stress disorder... the fact remains that a human being is dead due to the hands of someone else. The crime scene clearly potrays an individual who was capable of violence beyond comprehension. This stuff is happening all around us- the rich, the poor, the nice, the angered, the perfect little family, the family living in poverty... it doesn't even matter anymore what you look like, your status, your character. Perfectly normal people are going out there and becoming complete animals at the switch of a button. You can ponder all you want about why or that there has to be some sort of rhyme/reason, but the fact remains someone was murdered at the hands of another... and quite frankly a murder scene where over 300 wounds were inflicted speaks volumes about where this person belongs for the remainder of their life.
