the problem is states attorneys that rutinely convict people that are innocent to enhance thier sttanding while offering plea bargins to people whos lawyers can put up a better defence, in md a person on death row for the rape and murder of a 6 year old was cleared of the charges after the attorney that convicted him retired and his sucessor found the d.n.a. evidence of the case hidden in the bottom drawer of his desk the d.n.a. also incriminated a prson that had spent 6 months in the same cell as the convicted man. had the execution been faster than it was the innocent man would have died and the actual killer would have gone scott free. sadly the real killer was offered a plea bargin and never faced the death penulty that the innocent man had been condemed with and the states attorney that hid the evidenct was never charged with anything.

Well, Edward, that shouldn't be so simple to do in the slightest. If people are truly innocent, they should have other people who can say that they were nowhere near the crime scene at the time in question.
To James, yes, it is time to get rid of the death penalty because we KNOW that it is too expensive and impossible to correct if we make a mistake. Which it is known that we have put people to death who were actually innocent in every country that still has the death penalty.

Someone can go out and blow away a dozen people and anymore all you hear is "how did WE as society fail this poor person?" I say how about putting them DOWN like the monsters they are? I can think of much better uses for my tax dollars than to feed and shelter violent criminals. So they came from broken homes? So did I. Maybe had an abusive alcoholic for a parent? Me, too. Not much money growing up? Been there, done that. Those are EXCUSES for growing up into crime and NOT reasons. I'll save MY sympathy for the victims of violent crime and not for the perpetrators.

Here's a thought: how about empowering the people themselves with the right to defend their persons and property against crime, and not have to depend on the state? I'd wager that we would see a dramatic decrease in violent crimes if people were actually allowed to defend themselves instead of having to wait for police to show up. It would save a lot of resources as well.

In 1979 my uncle was in a neighborhood bar eating dinner with his girlfirend. His exwife saw them together and called her brother. He came up stabbed my uncle. While my uncle was on the phone with the police, he had ran home got a gun, came back and shot him. My uncle died on the way to the hospital, he was 27yrs old. the guy who shoy him was 17. He went to jail after being on the run for a few weeks. While in jail he also escaped. Sadly he was let out of jail within 7yrs. Where is the justice in that. my uncle didn't get out of his grave in 7 yrs for good behavior, why should the killer get out of jail. He deserved the death penality and I would have been more than happy to shot the needle or pull the plug...an eye for an eye...bring the death penality back and stop this 20-30 yrs on death row and years of appeals, my uncle can't appeal being 6 ft under. If dna or a video can prove they did it, schedule the procedure for the next week and stop wasting tax payers money feeding and housing these killers.

It'd be a reasonable cost cutting measure. Prisoners are expensive to keep alive. I'm not sure how anyone sentenced to life in prison without parole would consider the death penalty any more cruel or unusual.

Tim, no, it wouldn't. A death penalty case costs 1 million dollars to prosecute. To lock up someone for 40 years only costs 100K, so the cost savings are on the side of the life without parole option.

There once was a time, not long ago that I was an absolute proponent of the death penalty but like many other things as I've matured and become better informed, I'm not so much any more.
Since DNA has become the accepted form of definitive forensics many innocents have been discharged from their prison sentence, I'm not inclined to kill someone who stands a remote chance of being innocent. With life having less meaning to many as time goes on the more precious and valuable it is to me.
For the record I am a Dem but am not so liberal as I once was, but it does depend on the issue. As a huge true crime buff there are enough evil people that commit crimes so heinous and tortuous that don't deserve to live among good people. I'd include in that list pedophiles (biggest repeaters), rapists where conviction is absolutely proven (DNA), those that commit murder in most cases especially serial killers.
If we let those serving time for marijuana offenses out it would free up a lot of room in the prisons for the serious criminals. Marijuana is becoming more and more legalized all over the country and NO ONE has ever committed these type of crimes under the influence of pot (look it up, it's true).
We need the death penalty is some cases, not so much as a deterrent but more as punishment.

The death penalty is reprehensible. I do not believe in its use for people like George Bush, Dick Cheney, Don Rumsfeld, Coni Rice et al. for sending troops to Iraq under false pretenses. They killed both Iraqi and U.S. citizens in the hundreds of thousands range. They should be prosecuted, but as possible war criminals should not face execution. The death penalty violates the eighth amendment against cruel and unsual punishment. It does not bring closure and affects negatively even the executioners. Gov. Glendenning now regrets his killing of a prisoner, and says it was his worst decision while in office. Finally, violence permeates our society. We have to eliminate poverty, abuse and other ills which cause damage to disadvanted people, some of whom do horrible crimes. We must save the children now, and then enjoy a future with less violence..

In my humble opinion, I think the death penalty should be imposed if, and only if, there is DNA evidence to incriminate the suspect. This will eliminate all false convictions. Every innocent person who is released from prison is done so due to DNA. With no DNA evidence, No death penalty.

If the logic is "killing someone does not bring back your loved one", we could also say locking them up for life doesn't bring back your loved one either. I really am not too excited about this issue one way or another although I understand it costs lot to keep someone on death row with the appeals process and all. I do find the debate about it a little odd given the few number of actual executions which have taken place in this state.

To take someone's life is an enormous decision, with no turning back.
Life without parole is very much cheaper, and still leaves room in case of a changed verdict.

WHY is it that seemingly NO ONE discusses reserving the DEATH PENALTY for use against REPEAT offenders??---If someone has TWO separate convictions for a capital offense, the liklihood of BOTH being in error is DRAMATICALLY reduced! I do NOT favor executing anyone by mistake, but without a death penalty, WHAT is there as an incentive to the convicted person to prevent them from KILLING AGAIN?-Why not kill the guard(s) and escape, and then hunt down those involved in the conviction, and also kill them?--Nothing more would be done, the criminal already was convicted and sentenced to "life without parole"!--KEEP, and actually USE the death penalty for REPEAT capital offenders, AND first timers that both ADMIT the crime, without remorse, and evidence CONFIRMS their admission!--Why WASTE space and money keeping these people around? Robert, usually that is true. If someone is convicted two times of a capital offense, there is little to no possibility (save if their second crime was in prison, where you sometimes have to defend yourself with deadly force against others) of it being wrong.
Oh wait..... yeah, there is that possibility, as Texas found out recently when a person convicted of two rape/murders was exonerated by DNA evidence in BOTH cases.

If William Spengler was sentenced to death after brutally beating to death his 92 yo grandmother way back in 1980, the two firefighters he murdered after luring them to their death my setting a fire would still be alive. I understand that on a very rare occasion someone innocent could possibly be convicted and sentenced to death IF the judicial system fails them. That said I believe in an eye for an eye. It makes no sense to keep convicted murderous vermin alive and comfortable the rest of their evil pathetic lives at the cost of taxpayers. Perhaps bring back public hangings, though barbaric they are VERY EFFECTIVE at deterring crime.

All I'm saying is that public hangings are VERY EFFECTIVE at deterring crime. Criminals are given the message that no matter what heinous crime they commit in a state without a death penalty they will not pay for that crime with their life. What a stupid question. He was clearly mentally ill. Who should have been severely punished was whoever allowed him access to the deadly weapons, and encouraged his activities. But, when you really think about it, that is a terribly difficult issues altogether, since he killed her (his mother) first. This all illuminates the incredibly lousy health care system we have in this country.

The mother was the first victim of this tragedy. She received the ultimate punishment for poor gun safety. Sad, very sad. I'm sure she was trying to do the best she could with a severly disturbed son, with poor support from the mental health system.

In fairness to Mr. Lanza, we do not know the circumstances of his divorce other than he was paying a significant amount of alimony. We don't know what his relationship was with this 20 year old son also. It is impossible to know what the family situation was before and after the divorce.

I was just interested to see what the response would be. I would have thought someone might have said something like "I oppose the death penalty but if you gave me 5 minutes alone with Lanza he would wish he'd gotten the death penalty". Although I respect someone's position on this issue whatever it may be, some of the replies remind me a bit of the one Dukakis gave in the 1988 debate.
