Sex Charges Against War Vet are "Unfounded," Lawyers Say

According to The Gazette, a Bethesda 12-year-old claimed she was 20 and in the military, defense lawyers said.

Lawyers of a Falls Church man accused of soliciting sex from a 12-year-old Bethesda girl are calling charges against him “completely unfounded,” The Gazette reports.

Nathan Samuel Portnoy, 23, of the 2100 block of Emilys Lane in Falls Church, VA, has been charged with first degree assault, kidnapping of a child under 16, and sexual solicitation of a minor in the Aug. 24 incident.

Police and prosecutors say Portnoy met the girl online, asked her to have sex, and then pointed a gun at her sister and sister’s boyfriend near her home on Loch Lomond Drive. Police said they later found a loaded handgun, ammunition, gun holsters, handcuffs, zip ties, rope, a black ski mask, and several boxes of condoms in Portnoy’s truck.

Portnoy, a National Guardsman and Iraq war veteran, was hailed as a hero after McLean Patch reported. He performed CPR on Dylan Shawn Cooper, 19, but the teenager died from his injuries days after the storm.

"[The police’s] charging documents, if you read through them, affirmatively demonstrate that there was no kidnapping in this case,” Portnoy’s lawyer, Paul F. Kemp, said at a Tuesday bond review hearing, The Gazette reported.“… Furthermore, there was no sexual contact whatsoever; we suggest to the court that there is no valid charge.”

Kemp said the girl portrayed herself as a 20-year-old woman and claimed she was in the military, according to The Gazette. Kemp said Portnoy acted in self defense after being chased and threatened by the girl’s sister and sister’s boyfriend when he dropped the girl off near her home.

Tuesday, a judge reduced Portnoy's $1 million bond to $300,000, The Gazette reported.

“I decided to pursue a childhood dream," he said about his decision to join the National Guard. “When I was a kid I always wanted to be a solider."
